That the bishop is appointed exclusively by the cathedral and with the consent of the metropolitan.
Bishops cannot be ordained without a Council and in the absence of the regional metropolitan. But even in the case when he is present, it is better that all the concelebrants of this metropolitan region be with him, and the metropolitan should convene them with a message. And if everyone gathers, it’s better; if this is difficult, then in any case it is necessary that the majority be present or express their consent by letters, and thus, in the presence of the majority or by its decision, the ordination is carried out. If it is done differently, contrary to this definition, then the ordination has no force. But if the ordination is carried out in accordance with this rule, and some, out of ambition, begin to contradict, then let the opinion of the majority prevail.

Ἐπίσκοπον μὴ χειροτονεῖσθαι δίχα συνόδου καὶ παρουσίας τοῦ ἐν τῇ μητροπόλει τῆς ἐπαρχίας· τούτου δὲ παρόντος ἐξάπαντος, βέλτιον μὲν συνεῖναι αὐτῷ πάντας τοὺς ἐν τῇ ἐπαρχίᾳ συλλειτουργούς, οὓς καὶ προσήκει δι᾽ ἐπιστολῆς τὸν ἐν τῇ μητροπόλει συγκαλεῖν. Καὶ εἰ μὲν ἀπαντοῖεν οἱ πάντες, βέλτιον· εἰ δὲ δυσχερὲς τοῦτο εἴη, τούς γε πλείους ἐξάπαντος παρεῖναι δεῖ, ἢ διὰ γραμμάτων ὁμοψήφους γενέσθαι, καὶ οὕτω μετὰ τῆς τῶν πλειόνων ἤτοι παρουσίας, ἢ ψήφου, γίνεσθαι τὴν κατάστασιν· Εἰ δὲ ἄλλως παρὰ τὰ ὡρισμένα γίγνοιτο, μηδὲν ἰσχύειν τὴν χειροτονίαν.
